Terms & Conditions of Use
1. Who we are and what these terms cover
- Drivestay is operated by Zsolt Stelkovics, trading as Drivestay, an eenmanszaak registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 42074309, registered address Joh. Rosenkrantzlaan 12, 2104 CD Heemstede, the Netherlands (“we”, “us”, “our”, or the “Platform”).
- These Terms and Conditions (the “Terms”) govern your access to and use of the Drivestay website at drivestay.eu, our applications, and all related services (together, the “Services”). By selecting “Agree and continue” when you register, or by listing a space or making a reservation, you agree to these Terms and acknowledge our Privacy Policy. We record your acceptance, including the date and the version of the Terms accepted.
- A “Host” makes a private parking space or driveway available. A “Camper” reserves a space to park a campervan, motorhome, or similar self-contained vehicle — either overnight or for a defined daytime period. “User” means either or both.
- Drivestay provides parking. It does not provide accommodation, lodging, camping, or any place to stay. Campers sleep, when they do, in their own self-contained vehicles; the Host provides only the ground on which a vehicle is parked. Hosts offer space to park a self-contained vehicle and provide no accommodation.
- Drivestay offers two kinds of arrangement, governed by different sections of these Terms: a Free Tier (the Host offers parking for free, with no payment and nothing of value given in return — see Section 11) and a Paid Tier (the Camper pays to park through the Platform, by the hour with a daily maximum, or for a defined overnight period — see Sections 6 to 9). Sections 1 to 5 and 10 to 13 apply to both.
- We may update these Terms. We will notify registered Users of material changes by email and post the updated version with a new “last updated” date. Continued use after changes take effect constitutes acceptance.
2. Our role: we connect, we do not provide
This is the core of how Drivestay works and the most important section of these Terms.
- Drivestay is a technology platform that connects Hosts and Campers. We provide the marketplace, search, communication, and (on the Paid Tier) payment-handling tools that let a Host and a Camper find one another and enter into an agreement. We are not a party to that agreement.
- When a reservation is made, a direct contract is formed between the Host and the Camper for the use of the parking space. We are not the owner, operator, landlord, lessor, or manager of any space, and do not provide parking, accommodation, or any travel or hospitality service ourselves. We are not an insurer, not a broker or estate agent, and not a contracting or booking agent for either party, and we have no control over the conduct of any User.
- We do not own, control, inspect, manage, or supervise any listed space, and we make no attempt to verify Users' statements or to visit any space. We do not verify that any space is safe, lawful, accurately described, available, or fit for any purpose. Hosts are solely responsible for their spaces and listings; Campers are solely responsible for assessing a space's suitability before and while parked.
- On the Paid Tier, our handling of payment (through our payment processor, Stripe) is an administrative convenience to facilitate the contract between Host and Camper. It does not make us a party to that contract, the seller of any service, or responsible for its performance.
- Any rating, review, badge, or “verified” label reflects information provided by Users or automated checks of limited scope. It is not a guarantee or endorsement by us.
3. Eligibility and accounts
- You must be at least 18 and able to enter into a legally binding contract.
- You are responsible for keeping your login details confidential and for all activity under your account, and must notify us promptly of any unauthorised use. We are not responsible for loss arising from your failure to keep your credentials secure.
- You agree to provide accurate, current, and complete information and keep it up to date. We may suspend or close any account that breaches these Terms, provides false information, or is inactive for an extended period.
4. Host obligations
If you list a space as a Host, you represent, warrant, and agree that:
- you own the space, or have the full legal right and all necessary permissions — including from any landlord, tenant, mortgage holder, or homeowners' association — to make it available for parking;
- you are solely responsible for ensuring that the way you list and use your space is lawful where it is located — including whether overnight parking is permitted, whether charging for parking is permitted, and any applicable zoning, planning, permit, licensing, association, rental, or insurance requirements in your local jurisdiction. We do not verify and are not responsible for the legality of any listing or parking in any location;
- you will make the space available only to self-contained vehicles (vehicles with their own sleeping, sanitary, and living provisions) and will provide only the ground on which the vehicle is parked;
- you will not provide, install, or advertise on-site facilities or amenities such as electrical hookups, water supply, showers, toilets, or waste disposal. Providing such facilities can reclassify a space as a campsite or caravan site under local law and is outside what the Platform supports;
- your listing is accurate, including location, dimensions, access, restrictions, and price;
- you are responsible for determining, declaring, and paying any taxes on your income, and for any applicable tourist or visitor tax that may apply to paid overnight parking, regardless of how the activity is described. The Platform does not collect or remit any tourist tax on your behalf;
- the space is reasonably safe and free from hidden hazards you know of or ought reasonably to know of, and you will disclose known risks in your listing;
- you will honour confirmed reservations and treat Campers fairly and lawfully, without unlawful discrimination.
You acknowledge that you, not Drivestay, bear the entire risk arising from making your space available, including in relation to your neighbours, your municipality, and your insurer. We strongly recommend you confirm your insurance covers this activity before listing. We do not provide insurance of any kind.
5. Camper obligations
If you reserve a space as a Camper, you represent, warrant, and agree that:
- your vehicle is self-contained, roadworthy, insured, and lawfully permitted on the road, and you hold a valid driving licence;
- you will use the space only to park, for the purpose and period reserved, and in accordance with the Host's rules and restrictions;
- you assess the suitability and safety of the space yourself, and you use it entirely at your own risk;
- you will leave the space as you found it, cause no nuisance to the Host or neighbours, and dispose of all waste responsibly and off-site;
- you are responsible for your own safety, that of anyone travelling with you, and for your property and vehicle while parked.
You are solely responsible for your dealings with Hosts and other Users.
6. Paid Tier: reservations, prices, and fees
- Prices are set by Hosts. Paid parking is priced by the hour, subject to a daily maximum, or for a defined overnight period, and is shown before a reservation is confirmed. We charge a service fee (commission), also shown before confirmation. A reservation is confirmed when you receive confirmation through the Platform.
- To protect Hosts' privacy, the precise address is disclosed to a Camper only after a reservation is confirmed; until then, only an approximate location is shown.
- Cancellations and refunds are governed by the cancellation policy shown at the time of reservation. As an intermediary, our financial responsibility in any dispute is limited as set out in Section 9.
- Usage limits. We may set and enforce reasonable limits on the number of hours, nights, vehicles, or listings per Host or per space, and may decline or remove listings that, in our reasonable view, operate at a scale inconsistent with occasional private parking. We may introduce or change such limits at any time.
7. Paid Tier: payment, payouts, and verification
- Payments are processed by our payment provider, Stripe. By using the payment system you accept Stripe's applicable terms. We may charge the payment-processing costs indicated on the Platform.
- To comply with applicable anti-money-laundering and tax rules, Hosts may be required to complete identity and bank-account verification (Know-Your-Customer). Host earnings may be held in a Host balance until that verification and valid payout details are complete. If a Host does not complete verification or provide valid payout details within a reasonable period, we may withhold payout until it becomes legally permissible, in accordance with applicable law.
- We may be required to collect tax-identification information from Hosts and to report Host earnings to tax authorities under EU Council Directive 2021/514 (“DAC7”). Where this applies, you agree to provide the information we reasonably require.
- No off-platform or boundary circumvention. Hosts and Campers must not (a) redirect or encourage one another to communicate or transact outside the Platform — including by email, telephone, or messaging apps — where the purpose is to bypass our reservation, payment, or commission; or (b) use hourly or daytime reservations to arrange overnight parking where overnight parking is not permitted at that location. Repeated circumvention may result in account closure.
8. User conduct and content
- You must not use the Services for any unlawful purpose, post false or misleading content, infringe anyone's rights, or interfere with the operation or security of the Platform.
- You retain ownership of content you submit (such as listing text and photos) but grant us a non-exclusive, royalty-free, worldwide licence to host, display, and use it to operate and promote the Services. You are responsible for ensuring you have the right to share any content you submit.
9. Disclaimers and limitation of liability
- The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the Platform or about any Host, Camper, space, or parking arranged through it.
- We are not responsible for the acts or omissions of any User. Because the contract for parking is between the Host and the Camper (Section 2), we are not liable for anything that happens before, during, or after parking — including personal injury, illness, death, loss of or damage to property or vehicles, theft, nuisance, the condition, safety, legality, or availability of a space, or any dispute between a Host and a Camper. Each User deals with the other at their own risk.
- We are not liable for any indirect or consequential loss, or for loss of profit, revenue, data, or goodwill, however arising.
- You agree that these exclusions and limitations are reasonable, in particular because our Services consist only of providing the Platform, and responsibility for a space and for fulfilment of a reservation lies solely with the Host and the Camper.
- What this section does not limit. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence (opzet of bewuste roekeloosheid) on our part, or for any liability or mandatory consumer right that cannot be excluded under the law of your country of residence.
- Any claim against us must be notified to us in writing without undue delay and in any event within 30 days of the event giving rise to it.
10. Indemnity
To the extent permitted by law, you agree to hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, your content, or — for a Host — the condition or use of your space or your failure to comply with applicable law.
11. Free Tier (reciprocity)
- On the Free Tier, Hosts make a space available for parking entirely free of charge. No payment is made and nothing of value is given in return for the parking, and no payment flows through the Platform.
- Sections 2 to 5 and 8 to 10 apply to the Free Tier in full. The Host remains solely responsible for the legality of the listing and parking, and the Camper uses the space entirely at their own risk. We are equally not a party to, and not liable for, any Free Tier parking.
12. Privacy, suspension, and termination
- We process personal data in accordance with our Privacy Policy and the GDPR. The Privacy Policy forms part of these Terms and is available at drivestay.eu/privacy.
- You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Platform or other Users. Provisions that by their nature should survive termination (including Sections 2, 9, 10, and 13) continue to apply.
13. Governing law, disputes, and general
- These Terms, and any dispute arising out of or in connection with them or the Services, are governed by the laws of the Netherlands, and the competent court is the Rechtbank Noord-Holland (location Haarlem).
- If you are a consumer resident in another EU country, this choice of law does not deprive you of the mandatory consumer-protection rules of the country where you habitually reside. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
- If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale of the business. These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Services.
